Benzon, James Fredrick

James Fredrick Benzon, 37, Cottonwood Falls, formerly of Branchville, S.C., died Sept. 16, 2006, at Cottonwood Falls.

J a m e s Fredrick, the son of Mary Gibbons, was born Aug. 18, 1969, in Wichita. He graduated from Branchville High School, Branchville, S.C. He was in the U.S. Marine Corps, serving in the Gulf War. He was a carpenter employed by Cross River Construction and also a bartender at the Branding Iron Saloon in Strong City.

Fred is survived by his adoptive parents, William and Sharon Benzon, Orangeburg, S.C.; three sisters, Ashley Benzon, Orangeburg S.C., Kathy Johnson of Greensboro, N.C. and Tonya Courtney of Florence, S.C.; nieces and nephews.

A private inurnment will be conducted Thursday, Sept. 21,, at the Strong City Cemetery. Rev. Pat Ireland, Presbyterian Church, USA, Cottonwood Falls will officiate. Croy Funeral Home is in charge of the arrangements. Memorials may be made to the James Fredrick Benzon Memorial to help with funeral expenses.

Local man dies in early morning accident

A Cottonwood Falls man, James "Fred" Benzon, 37, died when he was struck by a pickup driven by Matthew Lee Rains, 23, of Cottonwood Falls at 2:52 a.m., Saturday, Sept. 16, 2006, said a Highway Patrol accident report.

Benzon, according to the Kansas Highway Department Crash Log, was walking on the east side of Highway K-177 (the northbound side of the road)—between Strong City and Cottonwood Falls, when he was struck by Rains' southbound vehicle after it had crossed the center line.

The Chase County Sheriff's Report indicated Rains was arrested following the accident and charged with: driving under the influence; transportation of an open container; reckless driving; obstruction of justice; leaving the scene of an accident; involuntary manslaughter; and driving left of center.

According to court records, Rains appeared in court Monday, Sept. 18, for his first appearance. He has been charged on six counts—involuntary manslaughter, DUI (driving under the influence), reckless driving, TOC (transporting an open container), leaving the scene of an injury accident and obstruction of official duty. The preliminary hearing in the case has been scheduled for 9 a.m. on Nov 9, 2006, the record stated.

Rains was released, according to court records, on a $50,000 conditional bond. He will remain under electronically monitored house arrest with exceptions (to see his attorney and to travel to and from work). The conditions of the bond, said court records, also preclude the use of any drugs or alcohol or entering any establishment where alcohol is sold or dispersed with the exception of grocery and convenience stores.

Rains will also be subject to blood, breath and urine tests when required by court services or law enforcement, records said.
